About Drivaq
Drivaq (“we”, “us”, “our”) operates an online platform that connects vehicle owners (“Customers”) with independent vehicle recovery operators (“Drivers”).
Drivaq does not provide vehicle recovery services and is not a recovery company. We act solely as a technology platform to facilitate introductions between Customers and Drivers.
Platform Role & Limitation
- Drivaq does not employ Drivers
- Drivers are independent contractors operating their own businesses
- Drivaq does not own or operate recovery vehicles
- Drivaq does not supervise, control, or manage recovery work
Any recovery service is a direct agreement between the Customer and the Driver.
Driver Responsibilities
Drivers using Drivaq confirm that they:
- Are self-employed or operating as a business
- Hold all required UK licences, permits, and certifications
- Have valid motor, recovery, public liability, and goods-in-transit insurance where applicable
- Are responsible for their vehicle condition, equipment, and compliance
- Are responsible for pricing, job acceptance, and service delivery
Drivaq does not verify the quality of work beyond basic onboarding checks.
Customer Responsibilities
Customers agree that:
- Drivaq only connects them with available Drivers
- Pricing, timing, and service terms are agreed directly with the Driver
- Any disputes regarding service quality, delays, or damage must be resolved with the Driver
Payments
- Payments may be facilitated through the platform or agreed externally
- Drivaq may charge a platform or service fee, disclosed at the time of booking
- Drivaq is not responsible for refunds, service failures, or payment disputes unless required by law
Liability Disclaimer
To the maximum extent permitted by UK law:
- Drivaq is not liable for loss, damage, injury, delays, or service failures
- Drivaq is not liable for actions or omissions of Drivers or Customers
- Drivaq is not liable for vehicle damage, mechanical issues, or consequential losses
Nothing in these terms excludes liability that cannot be excluded under UK law.
Insurance & Claims
All insurance claims relating to recovery services must be made directly with the Driver’s insurer.
Drivaq does not provide insurance coverage for recovery services.
Account Use & Suspension
We reserve the right to:
- Suspend or terminate accounts for misuse, fraud, or policy breaches
- Remove Drivers or Customers who damage platform trust or safety
Data & Privacy
Use of the platform is subject to our Privacy Policy and Cookie Policy, compliant with UK GDPR.
Availability
We do not guarantee:
- Driver availability
- Response times
- Job acceptance
The platform is provided on an “as-is” and “as-available” basis.
Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the UK courts.
